​​Daubert Challenge

The Daubert challenge is a means by which a trial judge can consider the admission of a Latent Print Examiner's testimony, by undertaking an assessment of the scientific evidence. This assessment will focus on the reliability of the methodology, principles and techniques of the science supporting the expert's testimony.

Under Daubert standards, the court will take into consideration and focus upon certain criteria during its determination of admissibility, and will take notice of the responses given to inquiries regarding the benchmarks of scientifically valid principles.

Daubert Benchmarks:
  1. Conformance to the Scientific Method
  2. Demonstrated objectivity
  3. Reliability of conclusions
  4. Adherence to methodology
  5. Validation of Principles 

It is critical for the expert to address these benchmarks properly, in order for Latent Print Impression evidence to pass the admissibility standards established under Daubert.
